"Draft final" Asset Transfer guidance available

The Asset Transfer section of the Act enables community bodies to apply to buy, lease, manage or simply use land and buildings owned by public authorities. 

Relevant authorities are required to have regard to guidance issued by the Scottish Ministers in carrying out their functions in relation to asset transfer.

All relevant documents are available on the Scottish Government website.

This guidance is published as a “draft final” version.  The statutory requirements and procedures are now fixed (subject to approval by the Scottish Parliament), but there is still flexibility to make the guidance clearer and you can find out how to comment at the link above.   Final guidance will be published when the legislation comes into force.

As we reported a couple of weeks back, the Community Planning near final guidance is also available. We'll provide more details on the participation request guidance and regulations when this becomes available.
